Terms of sale
The present document (Terms and Conditions) defines the conditions applicable to the sales concluded between on the one hand the people carrying out a purchase via the Internet site of Amélie Viaene SAS, hereafter called "the customer" and on the other hand the company Amélie Viaene SAS, hereafter called «amelieviane.com ». These conditions concern exclusively individual customers. These conditions apply to the exclusion of all other conditions, in particular those in force for sales in Amelie Viaene’s physical store.
These general terms and conditions of sale apply exclusively to individual customers who are not traders and are at least 18 years old.
The customer is understood to be any person who is acting for purposes that do not fall within the scope of his or her commercial, industrial, craft or liberal activity, who is at least 18 years old and who has ordered at least once on the site.
The creation of a customer account is reserved for all individual customers aged at least 18 years.
Prices
All prices are indicated in euros, including all taxes, but excluding the cost of processing and shipping (see Shipping and Delivery).
The articles will be invoiced on the basis of the rates in force at the time of the recording of the orders. They remain the property of amelieviaene.com until the complete payment of the price. This price is payable in full and in one payment.
Customs duties
Any order placed on the site and delivered outside of France may be subject to possible taxes and customs duties that are imposed when the package reaches its destination.
These customs duties and possible taxes related to the delivery of an article are the responsibility of the customer.
amelieviaene.com is not obliged to check and inform its customers of the applicable customs duties and taxes.
Ordering
The customer can place an order on the website www.amelieviaene.com. The ordering process is as follows:
Choice of articles and addition to the basket.
Validation of the contents of the basket.
Identification on the website www.amelieviaene.com if the customer is not already identified.
Choice of delivery method.
Choice of payment method and acceptance of the T&C.
Validation of the payment
The customer will receive an order confirmation by email.
The customer will be able to view the details of his order and its total price and correct any errors, before confirming it to express his acceptance.
amelieviaene.com reserves the property of the articles until the complete payment of the order, that is to say the collection of the price of the order by www.amelieviaene.com.
amelieviaene.com reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or who would present any form of risk in its eyes.
Any order implies acceptance of the prices and description of the articles available for sale.
Payment
Metropolitan France : The payment of purchases is made at the customer's choice: By credit card: Visa, MasterCard, Carte Bleue, issued in France, American express
International : The payment of the purchases is carried out with the choice of the customer: By credit card: Visa, MasterCard, Carte Bleue, American express
Payment validation : The payment is validated upon receipt of the additional information requested in the case of payment by credit card requiring additional checks (see paragraph Fight against credit card fraud).
Fight against credit card fraud
amelieviaene.com reserves the right to verify the personal data communicated by the customer and to adopt all measures deemed necessary to verify that the person whose bank account is debited is indeed the one who placed the order, in order to avoid any fraudulent payment. This verification may take the form of a request for proof of identitý and/or domicile and/or bank documents (RIB or cancelled cheque). The absence of response from the customer to a request of this type within 2 days following the request made by amelieviaene.com will automatically lead to the cancellation of the order concerned, and this without any possibility of subsequent claim.
amelieviaene.com will also be able to proceed to the direct cancellation of an order which would present one or several risk factors of fraudulent use of a bank card.
Security of transactions
amelieviaene.com uses all means to ensure the confidentiality and security of data transmitted on the web and on the website www.amelieviaene.com.

Responsibility
amelieviaene.com is responsible by right towards the customer for the good execution of the contract concluded with the customer.
However, amelieviaene.com cannot be held responsible for the non-execution or the bad execution of the contract concluded in case of force majeure, the occurrence of an event attributable to the customer or any unforeseeable and insurmountable inconvenience, inherent to the use of the Internet network, in particular a break in the service, an external intrusion or the presence of computer viruses.
The amelieviaene.com website contains hypertext links to other websites. The responsibility of amelieviaene.com could not be committed for the contents of these Websites if they were to contravene the legal and regulatory provisions in force.
The photographs and illustrations accompanying the products on our website have no contractual value and therefore do not engage the responsibility of www.amelieviaene.com.
Limited Warranty>
Amélie Viaene SAS commits itself to ensure that each product is rigorously in conformity with its quality criteria and that it has satisfied all the controls, both technical and aesthetic.
The jewels are guaranteed against the defects of conformity & redhibitory defects of manufacture, under the conditions envisaged in articles 1641 to 1649 of the French civil code, and L217-4, 5 and 12 of the code of consumption.
Article L. 217-4 of the French Consumer Code: The seller is required to deliver goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility.
Article L. 217-5 of the Consumer Code: To be in conformity with the contract, the goods must :
1° Be fit for the purpose usually expected of similar goods and, where applicable :
- correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
- have the qualities that a purchaser may legitimately expect, having regard to the public statements made by the seller, the producer or his representative, particularly in advertising or labelling;
2° Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.
Article L. 217-12 of the Consumer Code: The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.
Article 1641 of the Civil Code: The seller is bound by the guarantee for hidden defects in the item sold which make it unfit for the use for which it was intended, or which so diminish this use that the buyer would not have acquired it, or would only have paid a lower price for it, if he had known about them.
Article 1648 paragraph 1 of the Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
This warranty covers conformity and manufacturing defects but does not cover theft or damage caused by misuse of the jewellery. Any breakage or loss of stones or pearls, any deformation or destruction of the product due to external shocks or mishandling are not covered by the guarantee but may give rise to an estimate and repair subject to technical feasibility.
The customer has a 3 days deadline as from the reception of the articles to form any reserves or complaints for nonconformity or apparent defect of the delivered articles, by e-mail contact@amelieviaene.com or by registered mail with acknowledgement of delivery to the following address Amélie Viaene SAS, 62, rue Vaneau 75007 Paris.
Passed this time and in the absence of having respected this formality, the articles will be considered in conformity and exempt from any apparent defect and no complaint could be validly accepted by amelieviaene.com. If the apparent defect or the lack of conformity of the article is proven, amelieviaene.com commits itself to reimburse the customer as soon as possible and at its own expense. This reimbursement will take place within a maximum of 30 days.
